§ 15-10. Tobacco products and minors.

  • (a)

    Selling of cigarettes to minors. It shall be unlawful for any person to sell or otherwise furnish to a minor who is under the age of eighteen (18) cigarettes or tobacco products. Punishment for violation of this section shall be the same as the punishment for the violation of any other city ordinance.

    (b)

    Possession of cigarettes/tobacco products by minors. It shall be unlawful for any minor who is under the age of eighteen (18) to possess or have in his/her immediate possession any cigarettes or tobacco products. A minor who commits the offense provided for in this ordinance may be punished as follows:

    (1)

    By requiring the performance of community service not exceeding twenty (20) hours;

    (2)

    By requiring attendance at a publicly or privately sponsored lecture or discussion of the health hazard of smoking or tobacco use, provided such lecture or discussion is offered without charge to the minor; or

    (3)

    By a combination of the punishments described in subparagraphs (1) and (2) above.
